Änderungen bei der Mikroplastikbeschränkung?

Die sehr kurze Frist von wenigen Wochen zwischen der Veröffentlichung der Mikroplastikverordnung und ihres Inkrafttretens sorgte für Aufregung in einigen Teilen der Wirtschaft. Aktuell arbeitet Brüssel an einem Q & A-Dokument, das bei der Umsetzung der Vorschriften helfen soll. TIE und DVSI haben allerdings bereits eine Änderung der Leitlinien in Anhang XVII festgestellt. In der Passage der ersten Version über die dekorative Funktion von Glitter, die in der neuen Version gestrichen wurden, hieß es:

• ..in case of glittered articles for which the decorative function is secondary – such as textiles used for garments or footwear, glitter is always regarded as an integral part of the article. These glittered articles – eg: clothing shoes, curtains – are out of the scope of the restriction,…
• ..for glittered articles having a purely decorative function, or for which the decorative function is the main function of the article – such as textiles used in certain art and craft kits, toy/party hats, Christmas decoration, etc. – glitter can only be regarded as an integral part of the article if it does not detach from the article during normal use (including storage). In case of glitter detaches from the article during normal use end, the glittered article is to be regarded as a combination of an article (e.g. the article without the glitter) and a mixture (the glitter). In the latter case, the ban applies to the glitter (but in practice, the whole glitters article cannot be sold).

In der überarbeiteten Fassung der Kommission heißt es nun:

• Loose plastic glitter for uses without a transitional period – such as art and crafts, toys – is banned as of 17 October 2023 (unless biodegradable or soluble or otherwise degraded). However, plastic glitter is not affected by the ban if it is contained by technical means, forms solid films (e.g. paints, certain inks) or, during end use, it is permanently incorporated in a solid matrix (e.g. glitter glue).
• Articles with glitter affixed on their surface do not fall within the scope of the restriction.

Die unterstrichene Einfügung könnte bedeuten, dass es eine Lockerung bei Artikeln gibt, auf denen Glitter angebracht ist, z. B. bei Hütten mit aufgeklebtem Glitter. TIE bat die Kommission um Stellung­nahme. Die Antwort steht noch aus.

Loser Glitter wie auch Schleim mit Glitter sind nach wie vor verboten. Die Leitlinie, die Patrizia Tosetti von der Kommission im vom DVSI initiierten Call am 20. Oktober 2023 für Ende letzten Jahres angekündigt hatte, wird spätestens Ende März 2024 erwartet.
